Ex-PM Yingluck Shinawatra Monday urged Prime Minister Prayut Chan-o-cha not to issue an administrative order to make her pay compensation for state losses over the rice-pledging scheme.
She said such an order was against the rule of law since the court had yet to rule on a criminal case against her.

She said Prayut's legal specialists had "adopted a legal technique" to seek compensation by having the PM issue an administrative order without seeking Cabinet approval to make individuals pay compensation, like an order to seize assets. This was to avoid hefty court fees when filing a civil suit, she said.

She called on Prayut to opt for court procedures to seek civil liability, since the court was regarded as a justice channel.

"For issuing this administrative order, it is like you exercise your power like a court issues a verdict as you incriminate individuals who must pay compensation over the rice pledging scheme - even though the Supreme Court has yet to rule on a criminal trial. This is a grave violation against the rule of law,'' she said.

Thaksins Hasspredigern geforderten Volksgerichtshöfe.

Umso erfreulicher ist dass diesmal ein wirklich Schuldiger davon betroffen wird.

PRIME MINISTER Prayut Chan-o-cha insists that his government will go ahead with a civil compensation claim against former prime minister Yingluck Shinawatra to recover losses from her government's rice-pledging scheme."This is an administrative matter. If [Yingluck] wants, she can appeal to the Administrative Court.

"It is clearly written in the law that the PM and ministers are covered," Prayut said, responding to Yingluck's argument that administrative measures can only apply to the prime minister's subordinates.

Meanwhile, former PM and Democrat Party leader Abhisit Vejjajiva said Yingluck's open letter to Prayut could be considered a tactical move to counter legal action being taken against her.

In addition to the criminal offence being considered by the Supreme Court, Yingluck is facing this massive compensation claim in the Administrative Court under the Administrative Procedure Act's Section 57.

According to Abhisit, Yingluck's explanation of her position in the rice-pledging programme stated in the open letter to Prayut may also serve as a |crucial point in her legal defence |against criminal charges in the Supreme Court.

As a politician, Yingluck needs public space to clarify the issue, he said, adding that he believes the government is in its rights to exercise its authority under Section 57 of the Administrative Procedure Act to seek compensation from Yingluck. Her government's rice-pledging scheme caused huge losses because it set the price of rice much higher than world market prices, he claimed.
Alles sehr richtig!

Es wäre ein Novum für Thailand dass ein entweder total unfähiger oder aber hochgradig
krimineller und korrupter Politiker für den Schaden den er angerichtet hat zumindest
nominell haftbar gemacht wird, auch wenn bei ihr nix zu holen sein wird.

In Yinglucks Fall trifft wohl beides zu:
Unfähig ihr vorgeschriebenes Handeln überhaupt zu verstehen und durch und durch
kriminell auch wenn sie ständig die Unschuld vom Lande spielt.

Ich hoffe sehr dass dieser Fall durchgezogen wird und dass auch zukünftige Regierungen
zur Verantwortung für ihr Handeln gezogen werden.

Denn Korruption und hochgradige Kriminalität gab es nicht nur in der Yingluck
Regierung und gibt es nicht nur im Shinawatra-Pombejra Clan.
Aber Thaksins Reisbetrug war schon das Grösste was uns jemals geboten wurde!

und den Spott garnicht versteht ist es wieder mal eine Null Nummer.

THE PHEU Thai Party has defended former prime minister Yingluck Shinawatra over allegations related to the party's flagship rice-pledging scheme that caused up to Bt500 billion in damages to the state.
The party yesterday issued a statement stating the government's move to make Yingluck pay over civil liability incurred from the scheme has sparked criticism about a lack of transparency and justice in the legal procedures against her.

Pheu Thai claimed that the Abhisit government had caused losses to the state from its rice subsidy scheme and the Prayut government had caused Bt4 billion in losses from rubber deals with the Chinese government but no action was taken.
Es ist für mich eine Genugtuung nach sovielen Jahren in denen es Thaksin durch
Bestechung und seine Hundertschaft Rechtsverdreher gelang das Thai Justizsystem
ad absurdum zu führen dass jetzt sein Nummerngirl keine solche Möglichkeiten
hat.
Natürlich ist Yingluck nicht hauptschuldig, aber sie war zumindest auf dem Papier PM
und Vorsitzender des Reis Ausschusses der den Betrug absegnete.

Die Vorwürfe gegen Abhisit und Prayuth sind haltlos.

Abhisits Reis Subventionssystem war das Beste was es in Thailand
je gegeben hat, weil am Effektivsten.

Dass auch dabei Korruption vorkam lag nicht am System sondern an den Leuten.

In Thailand wird immer geschmiert wenn man die Möglichkeit dazu hat.

Bei Thaksins Reisbetrug war die Korruptionsmöglichkeit von Anfang an
mit eingebaut wie Abhisit lange vor dem Betrug im Parlament schon aufdeckte.

Prayuth verkaufte nur den Kautschuk den Yingluck vorher subventioniert hatte.

Ausserdem gibt es beim Kautschuk weniger Betrugsmöglichkeiten wegen
fehlender Müller und Lager Betrüger.

THE Supreme Court’s Criminal Division for Political Office Holders will hear the first witness testimony on January 15 next year and the last testimony on November 18, in the case against Yingluck Shinawatra, the court said yesterday.

Yingluck thanked the court for allowing testimony by witnesses, such as Chalerm Yoobamrung, who did not have a chance to give a statement to the National Anti-Corruption Commission.

Yingluck also thanked her supporters, who said they would wear red as a gesture of support for her on Sunday. She advised them to heed the government’s order, as she wanted peace and reconciliation in the country.

Norrawit Larlaeng, Yingluck’s lawyer, said the defence witnesses include Yingluck, former Finance Minister Kittiratt Na-Ranong, former deputy prime-minister Niwatthamrong Boonsongpaisan, former chief adviser to the PM Olarn Chaiprawat, former deputy commerce minister Yanyong Puangrat, veterinarian and academic Chai Watcharong and CP Intertrade chairman Sumet Laomoraporn.

Interessant ist das Thaksins Mafia Buchhalter Kittirat der vorher abgelehnt hat
als Zeuge aufzutreten plötzlich dazu bereit ist.Es geht wohl ums eingemachte.

Papperlapapp ! Es geht nicht um Versöhnung sondern um Bestrafung
von Schwerkriminellen. Auch wenn man ihn als Anführer nicht bekommt.

Als Suthep Mitläufer und Mittrillerer wäre ich ja schon froh wenn der Prozess
ausserhalb des Menstruationszyklusses Yinglucks ablaufen würde!

FORMER COMMERCE minister Niwattumrong Boonsongpaisan has testified before a government committee that former prime minister Yingluck Shinawatra did not commit wrongdoing in the rice-pledging scheme despite an estimated "loss" of Bt600 billion in taxpayers' money as alleged by the government.
Niwattumrong also handed over several hundred pages of documents to the committee detailing the rice-subsidy programme, which he said was executed in accordance with a 2003 Royal Decree.

He argued that the programme was good for the economy, resulting in increased tax revenue and higher incomes for farmers.

The former commerce minister is one of the defence witnesses in a civil compensation case being prepared by the government in which Yingluck stands accused of causing severe financial damage to the state as a result of implementing the farmer-subsidy programme.

Niwattumrong also argued that the programme did not take into account profits and losses, since it was a subsidy policy promoted during an election campaign. He said more than 10 government agencies were involved in the programme and none of them voiced opposition.

In addition, the National Economic and Social Development Board and Budget Bureau did not raised any objections either, he said, adding that both agencies were empowered to do so.

However, he said, non-government organisations or independent think-tanks such as Thailand Research and Development Institute were not authorised by law to oppose government programmes, even though the TDRI was the leading critic of this scheme, suggesting it would cause more damage than benefits.

Niwattumrong said the subsidy programme had contributed Bt350 billion to Bt700 billion to the economy during its lifetime, while farmers benefited from combined income of Bt140 billion per year thanks to the high price of rice pledged with the government at Bt15,000 per tonne.

He also said the government's tax collection was increased by Bt100 billion because of the implementation of this programme.

The former commerce minister said Yingluck as prime minister implemented measures to prevent fraud and corruption in this scheme and the current government should punish wrongdoers on a case-by-case basis.

At its peak, the government's rice inventories shot up to a total of 18 million tonnes after buying up the rice from farmers at a price much higher than the world market, allegedly resulting in a huge cost to taxpayers. Over the years, about 6 million tonnes have sold into the market, raising about Bt70 billion, and the overall cost is estimated at around Bt600 billion.

In addition, the rice-trading mechanism was distorted, resulting in negative consequences on exports, according to the programme's critics.

Da Thaksins Mitkassierer in der Lage seien müssen vollkommen an der Realität und Tatsachen
vorbei zu argumentieren um richtig Kasse zu machen, hat dieser Fiffi hiermit wohl schon
seine Bewerbung für die nächste Thaksin-Marionettenregierung abgegeben.

Unglaublich, solch wirres Zeug sondert noch nicht mal Innenminister DieMisere in Berlin ab.
Selbst wenn der ex und hopp Minister Niwat...... sein Thailändisches Grundrecht darauf
nicht rechnen zu können geltend macht sollte ihm aufgefallen sein dass noch
während seiner Amtszeit der Regierung Yingluck das Geld ausging weil das Programm
so erfolgreich war.
Wobei die Betrüger alle ihr Geld im Sack hatten , nur die armen Reisbauern nicht
und deshalb in BKK demonstrierten!

Aber sonst war Alles prima!
Jedenfalls für ihn!

Ich hoffe sehr auf einen kurzen Prozess während der Militärregierung
sonst wird es wieder nix.
Siehe den Korruptionsprozess Juthama der sich seit der Abhisit Regierung
hinschleppt und während der Yingluck Regierung fast gestoppt wurde.
Nur auf Ami Druck ging es da weiter!

Trotzdem ist es falsch nur Yingluck anzuklagen.
Alle beteiligten Minister und besonders die beteiligten Firmen sollten
angeklagt werden.
Bei Yingluck ist eh nix zu holen.Ihre Riester Rente liegt auf BVI.

Yingluck hat zwar nie verstanden was sie vorgelesen hat
aber als Darstellerin ist sie allererste Sahne.

Da macht ihr keine Thai Soap Schauspielerin etwas vor.

Die mögen zwar sehr gekonnt die unverstandene Blöde spielen.

Aber sie hat ihre Kernkompetenz darin.

Yingluck changes strategies with the political seasons

"I AM not in a position to demand anything - even justice - because everything goes according to what this government wants. The government must decide what the public stands to gain from ordering me to pay civil liability.''
These are the strongest remarks Yingluck Shinawatra has made since May, 2014, when the military staged a coup to bring down her government.

Reading between the lines, the former prime minister is trying to say that if she is found guilty, it will not be in accordance with the justice system, but rather what the government wants. She made the claim despite her own observations that the government wanted to avoid a hefty court fee by pushing her to petition the court to appeal the tentative order to make her pay compensation for civil liability over the rice pledging scheme.

Yingluck had been keeping a low profile, even when travelling to the court for a criminal trial for gross negligence over the rice subsidy scheme that allegedly resulted in massive damage to the state.

Yingluck chose a softer approach by pleading for justice - but she changed her stance after the government of Prime Minister Prayut Chan-o-cha opted to issue an administrative order to make her pay for civil liability incurred from the rice-pledging scheme, which is said to be up to Bt500 billion.

From then on, Yingluck has fought tooth and nail by having her legal team argue via the media that resorting to civil liability was not fair because the Supreme Court had just started the criminal trial and she was not yet convicted of any offences.

What interests the public now is what political manoeuvres Yingluck will resort to from now on. She has created a high profile by keeping herself in the media spotlight daily, but then she realised that making newspaper headlines and sparking front-page stories did not change the negative force she was facing.

But she also knows that keeping "cool under pressure" will not stop people in power from "going after her" because they believe her actions caused massive damage to the country, which gave them legitimacy to press for her speedy prosecution.

Some top politicians had earlier thought they could negotiate with people in power to be lenient with Yingluck in the name of reconciliation. This notion has proven to be just too dim a hope.

What Yingluck supporters can do now in this battle is to win the hearts of the masses, which is difficult because no politicians have stood up to 'fight for the people" or "side with the people" since the coup was staged.

What Yingluck's camp can do is to claim that the rice-pledging scheme was implemented to help poor farmers. A case in point is red-shirt leader Nattawut Saikua's call for the people to write essays entitled "The day that there is no rice-pledging scheme".

Last but not least is Yingluck's remark: "This is a historic case that is imprinted in [her] heart and in the people's hearts as this will be the norm that is used against future PMs who implement policies to help people.''

Not yielding to negotiation with people in power - but winning the hearts of the masses is Yingluck 's strategy to survive the political storm. But critics may wonder if "her pleading for the public support is too late".
Man sollte Thaksins PR Fähigkeiten nicht unterschätzen, er hat bisher jede Nachfolge Regierung
propagandamässig weit geschlagen.

Und man sollte Yinglucks Wirkung auf das Wahlvieh nicht unterschätzen.
Sie verkörpert alle negativen Thai Eigenschaften mit denen man
eventuell Profit herausschlagen kann:

Lügen bis der Arzt kommt, sich vom Täter zum Opfer stilisieren und jammern, viel jammern.
Leider ist in der Militärjunta garkein Ausländer sonst könnte sie auch diese Karte noch spielen.
Und die Fahne nach dem Wind hängen wird in Thailand als Gipfel der Zivilcourage angesehen.

Ja, es ist wirklich sonderbar, wie man ploetzlich nach Gerichten ruft, denen man sonst meistens politische Entscheide vorwirft .
Aber man rechnet wohl damit, dass die Zeiten schnell Sendern.
