Anti-corruption agency to study impeachment petition against lawmakers

BANGKOK, Nov 21 – Thailand's National Anti-Corruption Commission (NACC) today set up an investigative committee to specially review the impeachment petition against the president of Parliament, his deputy and 308 legislators claimed to have unlawfully advocated the charter amendment.



The lawmakers were charged with breaching the Constitution by approving the charter review paving the way for a Senate composed entirely of elected members, not having some appointed as imposed in the current Constitution.



The Constitution Court handed over its verdict yesterday.



Parliament president Somsak Kiatsuranont and vice president Nikom Wairatpanij were among the MPs against whom a group of 40 senators initiated impeachment proceedings.



Appointed senators Wanchai Sonsiri and Prasarn Maruekpitak, two of the 40-Senators Group, said they will hand over the Constitution Court’s verdict on the case to the NACC tomorrow to help speed up the investigation.



“The documents will be useful for the NACC. We will seek legal action against the legislators for ignoring their official responsibilities and counterfeiting official documents,” they said.



They said the move to impeach the Parliament president, vice president and lawmakers was not revenge but manoeuvring in accord with the rule of law.



Though the House of Representatives is dissolved, their offences remain valid, they said.



Parliament president Somsak said he would consult Parliament's legal team and would be ready to clarify to the NACC, insisting that there was no cause for concern as he had strictly followed the law. (MCOT online news)

Der naechste Schlag. Ganz offensichtlich sind die Beweise, die einen Misstrauensantrag rechtfertigen nicht unter den Tisch zu kehren.

Auf die Diskussion im Parlament bin ich gespannt :mrgreen: .

House speaker accepts censure motion

The Nation

BANGKOK: -- Somsak Kiatsuranont, speaker of the House of Representatives, has agreed to put the opposition's censure motion against the premier and her ministers on the House agenda, though a copy of the impeachment request against the PM is required before the motion can pass. The deadline for this is Monday. He did not say when the censure debate will take place.

This impeachment request, as per the Constitution's Section 116, will also set the direction the censure debate will take.

Somsak said that whips from both parties would have to choose their motions on the day of the censure debate, but this must be done before November 28 - the day the current parliamentary session ends.

Chief opposition whip Jurin Laksanawisit said the censure debate against the government was in keeping with the Constitution, adding that it should be allowed to continue for at least three days so the opposition has time to investigate.

und nun erklärt die Gruppe Network of Students and People for Thailand’s Reform auch noch, das Yingluck dem König ein illegales Dokument vorlegen wollte bwz. schon hat.
Könnte ja schon fast LM sein - versuchter Betrug :mrgreen:

Ja, es wird richtig spannend. Mal sehen, was bis zum 29.11. passiert - da soll die Regierung ja am Ende sein. Sagt zumindest Suthep :joint:

YL hatte die Dreistigkeit die Verfassungsaenderung, bezueglich der Zusammensetzung des Senats, dem Koenig vorzulegen, ohne die Entscheidung des Verfassungsgerichts abzuwarten.

Man hat ihr bereits am 20.11.2013 nach Bekanngabe der Verfassungsgerichtsentscheidung geraten die Papiere schleunigst zurueck zu ziehen.

After being on the defensive for the past week, the Pheu Thai Party is countering Democrat Party moves with legal action on an "eye for an eye" basis, a high-ranking Pheu Thai source said.

Abhisit said his party condemned Pheu Thai's defiance of the court's authority, as it undermined the rule of law.

He called for Yingluck and her party to rethink their attack on the Constitutional Court and take responsibility for their actions.

"Prime Minister Yingluck, who has submitted the proposed amendment to His Majesty for endorsement, should report the court's ruling to the King," Abhisit said.

The prime minister yesterday responded to the court's rejection of the Senate-change bill, saying she needed time to study the verdict before charting her next move.

"What happened was unprecedented, hence I have asked the Council of State and the legal team to study [the implications]," Yingluck said.

She defended her decision to submit the change for royal approval, saying she was constitutionally bound to do so by the deadline.

In response, the opposition called for Yingluck to take responsibility for the hasty royal submission and resign.

The prime minister voiced optimism that the legal wrangle over amending the charter would eventually be resolved. However, she refused to comment on Pheu Thai plans to impeach Constitutional Court judges for striking down the charter amendment.

"I just want all sides to heed the opinions of one another and carefully consider the various options," she said.

Regarding the National Anti-Corruption Commission inquiry on accountability based on the verdict, she said she hoped the justice dispensed would allow everyone to carry on with his or her work.

NACC assures fairness and prudence in impeachment case

The National Anti-Corruption Commission (NACC) will exercise prudence and caution in considering the impeachment case against 312 senators and MPs who endorsed the draft constitutional amendment, said Mr Vicha Mahakhun, one of the commissioners, on Monday.

He also dismissed as untrue a report that the commission would be able to finalise the case within this month.

The commission is due to discuss the case on Tuesday in order to set the outline of the work, said Mr Vicha, adding that the commission is yet to receive the judgement of the case from the Constitution Court.

Also, he said that the committee had not yet invited the five complaints who initiated the impeachment bid for questioning.

The NACC, said Mr Vicha, must be fair to all parties concerned. Citing the voting for the draft by means of inserting ID cars into the slot by an MP on behalf of his colleages which is considered as a cheat, he said that not every MP was faulted and the commission will have to find out who are at fault.

Es ist wichtig die Auseinandersetzung zwischen der Regierung, die von einem Tyrannen, auf der Flucht, manipuliert wird und der Opposition juristisch zu fuehren.

NACC form committees to probe impeachment case against lawmakers

The National Anti-Corruption Commission has set up working committees to proceed with the investigation against 312 senators and MPs facing an impeachment bid for their role in endorsing the draft constitutional amendment.

Mr Sansern Poljiak, deputy secretary-general of the NACC, said Tuesday that the general assembly of the commission which held its first meeting to discuss the case agreed that there was ground to proceed with the investigation into the case.

The assembly agreed to set up a committee whose responsibility is to collect all relevant evidences pertaining to the case and to get the full text of the court’s judgement for use in the investigation process.

Mr Sansern said that the NACC would not base its judgement on just the court’s decision but would also take into consideration the conduct of the individual lawmakers.

After the completion of evidences collection, he said senators and MPs would be invited to give their sides of the story.

He further said that the commission would try to wrap up the case as quick as possible because it is of public interest.’

Das verstehe ich unter demokratischer Rechtsstaatlichkeit.

Es besteht durchaus berechtigte Hoffnung, dass sich etwas bewegt in diesem Morast.

NACC meets to decide fate of 312 lawmakers December 13

The National Anti Corruption Commission will meet December 13 to consider fates of the 312 members of Parliament (MP) and senators who proposed the “unconstitutional” charter amendments to change the composition of the Senate.

A NACC commissioner Vicha Mahakhun said the meeting on December 13 would be the examination and inquiry process of all evidence to find out whether these lawmakers had committed wrongful acts or not.

He said if inquiry into the evidence shown that these lawmakers had committed a wrongful offence of malfeasance in office, then it would enter the process to summarize and prepare a verdict to be submitted to the Supreme Court of Justice’s Criminal Division for Persons Holding Political Positions.

He said that the process would not take long time but could not say exactly when it would be finished.

Commenting on the People’s Council as called by the protest leader Suthep Thaugsuban, the NACC commissioner said that this would be done son through the issuance of a royal decree and allowed the caretaker government to proceed as an urgent case.

Asked whether the caretaker prime minister Yingluck Shinawatra could step down or not as demanded by protesters, he declined comment but recalled that this had happened at the time when Prime Minister Thaksin Shinwatra was in power and had stepped down from caretaker prime minister, and appointed Pol Gen Chidchai Wanasathit to perform duty.
