Die Dreistigkeit mit der Thakki & Co. versucht die Verfassung auszuhoehlen, um seine Diktatur zu errichten, ist sehr gefaehrlich fuer die Gesellschaft.

Der gesellschaftliche Widerstand muss wachsen, um nicht einestages in einer roten Diktatur aufzuwachen.

Pheu Thai to go ahead with charter amendment

The ruling Pheu Thai Party leader Charupong Ruangsuwan today insisted on the amendment of the Constitution to achieve what he called to bring back the country “democracy” which the people could fix their own directions.

Charupong reiterated his party’s stance to continue the charter amendment though amendment to the charter regarding the composition of the Senate was rejected by the Constitution Court yesterday, and another amendment to the amnesty bill was forced to be withdrawn from Parliament following massive protest by all classes of the Thai societies.

Another 2 trillion baht loan bill is also on the list of facing interpretation from the Constitutional Court after the opposition officially asked the House Speaker to stall the bill pending petition to the court.

Charupong said that before attending the meeting of the party to discuss the Constitutional Court’s ruling yesterday and work out the party’s stance on the charter amendment.

Earlier he had adamantly announced to reject the ruling of the Constitutional Court although the Opposition said such rejection was a blatant defiance of the Judicial power and could subject to a rebellion charge.

Pheu Thai to resurrect Article 291 of the charter

The ruling Pheu Thai party will resurrect another draft constitutional amendment still pending in the parliament to pave the way for the writing of a whole new Constitution, said Pheu Thai MP for Chiang Rai Samart Kaewmeechai on Thursday.

The draft which seeks to amend Article 291 of the Constitution has passed two readings of the House and is still pending for the third and final reading after the Constitution Court ruled that amending the article in question was not unconstitutional but suggested that public hearings must be held first to gauge the opinions of the public.

Since the charter court did not oppose amending Article 291, Mr Samart said the Pheu Thai party would continue with ramming the draft amendment through the third reading of the House to pave the way for the creation of an assembly to craft a new charter.

The Chiang Rai MP disclosed that the party’s legal experts were pondering a lawsuit to the court against the Constitution Court judges on charge of abuse of authority.

Meanwhile Ubon Ratchathani MP Somkid Chuakhong said he could not accept the charter court’s ruling which bans spouses, parents or children of incumbent MPs to become senators so that the Senate can function as a check-and-balance against the House.

Mr Paichit Srivorakhan of Nakhon Phanom decried the court’s ruling as unfair.

Prime Minister Yingluck Shinawatra was not held accountable for the failed draft constitutional amendment which was ruled unconstitutional by the Constitution Court, said deputy government spokesperson Sunisa Lertpakavat Thursday.

Speaking in defence of the prime minister who is now placed under pressure to resign by the Democrats, Ms Sunisa argued that the draft was proposed by the MPs and senators and the government had nothing to do with it. :totlach:

Nun versucht man es so zu drehen, das die Verfassungsrichter den König beleidigen würden, indem sie ihm mit diesem Urteil eine bereits übergebene
Vorlage wieder wegnehmen wollen.

Ich sehe das aber andersrum. Die Regierung hat versucht den König zu täuschen, indem sie ihm schnell eine illegale, verfassungswidrige Vorlage unterjubeln
wollten.

Weiters will man gegen die 5 Verfassungsrichter vorgehen, da die kein der PT angenehmes Urteil sprachen. Also dürfen in Zukunft Richter nur mehr zugunsten der PT
Recht sprechen, wollen sie nicht später angeklagt werden.

Braucht man dann überhaupt noch ein Gericht?

Thaksins Siegertruppe ist aus ihrem hochnäsigen Aufgalopp plötzlich ins Straucheln
gekommen.
Dies müssen alle Thaksin Gegner unbedingt ausnutzen und
ihn nicht weiterhin die Presse beherrschen lassen.
Thaksin hat noch nie ein Gericht oder eine andere Instanz anerkannt die
nicht in seinem Sinn entschieden hat.
Er schlägt erst zu und spielt dann Opfer!

Armed Forces now calls for national unity before it is too late



The Defense Ministry spokesman came out today for the first time to directly criticize the ongoing political turmoil with call for all sides to put an end to the widening and deepening conflict in the country before it gets out of control and is too late.

Maj-Gen Surachart Jitjaeng, spokesman of the Defense Ministry’s Public Relations and Information Office, said the political situation has intensified after the ruling of the Constitutional Court over the composition of the Senate.

He said rift was everywhere and deepened not only among politicians, but also media with conflicting news presentation, fabrications and bias.

They seemed not to accept the view of each other but merely wanted to defeat and overcome another just for the interest of their own groups.’

Such situation would jeopardize national security, he said.

He said that national conflict has developed throughout the past nine years and was deepening.

It is the time now for all these conflicts to end and all disputed parties coming out to face each other peacefully with talks as everyone shared the common love of their institutions and their country.

He said the past history has reminded all Thais that whenever Thai people disintegrated and struggling for power emerging, disaster will ensue.

Thailand has been regarded a land of smile and a land filled with hospitality culture but now are all these cultures still existing, he asked.

He said the current political instability is undermining national security, adding without security, the country could not survive.

The spokesman then called on all sides to set aside individual interest, stop creating hatred and stop hurting the country, but restoring peace and bringing happiness back to the people.

He said Thai people love their monarch, love the country and religion and therefore should come together to build the country before it was too late.

YL sollte doch klar sein wer der Oberbefehlshaber des Militaers ist...
richtig, ich habe aber starke Bedenken, das ein Putsch momentan das richtige wäre. Yingluck macht soviele Fehler, das man sie recht einfach juristisch
weg bekommen würde. Wenn aber Putsch, dann würde ich Wahlen ganz weit nach hinten schieben. Erstmal einen neutralen (kein Militär, kein DP oder PT)
PM einsetzen und dann mal den ganzen Stall ausmisten. Überprüfungskommission einrichten und nachsehen, wo die ganzen Gelder versickert sind, vor allem beim
Reisprojekt und auch bei der Hochwasserhilfe. Danach Anklagen vorbereiten, die korrupten Politiker aburteilen und das Volk in Demokratie schulen.
Demokratie setzt ja Informiertheit der Wähler voraus und da hapert es immens.

Was mich aber auch wundert, das Yingluck scheinbar nicht mal ihren eigenen Sprecher unter Kontrolle hat. Wer hat den diesen beauftragt, dieses Statement
abzugeben - Prayuth? Yingluch sicherlich nicht....

The former head of the 9-member Constitutional Court yesterday advised Prime Minister Yingluck Shinawatra to seek royal permission to return the draft amendment regarding the composition of the Senate to the government.


The advice of the former head of the court Wasan Soiphisu came after the prime minister has earlier submitted the controversial legislation to the King for royal approval despite that it was still pending the ruling of the Constitutional Court of its constitutionality.

Her speedy submission of the legislation to the King raised strong criticism from the opposition as inappropriate as the legislation had problem and therefore should be held until the Constitutional Court’s ruling.

But several legal advisors of the prime minister came out to defend her submission saying if the prime minister did not submit the legislation to the King within 20 days after its passage from the Parliament, she would be found guilty of violating the Constitution. But the opposition argued that speedy submission before it was cleared of its constitutionality would only annoy His Majesty and inappropriate.

The former chief of the Constitutional Court Wasan said during an address at a special discussion “Judicial System and the Survival of the Country”, that the prime minister now has two choices to do.

He said that as the legislation regarding the composition of the Senate has been ruled unconstitutional by the Constitutional Court, it now became clear that all process regarding the composition of Senate was over.

He said now the legislation is in the consideration process of the Office of His Majesty’s Principal Private Secretary before proposing for royal endorsement.

He said the prime minister has two choices, to seek royal permission from His Majesty to return the legislation to the Government, or just keeping it there until it is returned by the Office of His Majesty’s Principal Private Secretary.

For himself, he said he guessed that this legislation would be returned to the Government by the Office.

He said that the legislation could not revive or do anything with it, adding it was over.

He said the Parliament could not stubbornly imply Article 151 of the Constitution to revive it as it was not the case which His Majesty has rejected the bill because it was in the consideration process of His Majesty’s Office of the Principal Private Secretary.

He said that after the court has reached the ruling, further legal action to take against those who pushed the passage of the bill was not stated by the Constitution that it is the duty of the Constitutional Court.

However he said that it is the duty of the National Anti Corruption Commission (NACC) to consider legal action as the ruling committed all government agencies to abide by.

The former court chief also commented that each step which this government was walking right now resembled the step of the former Nazi leader had walked in disabling the Parliament to remain in power. Instead of checking and balancing the power of the government, the legislative power now has come under the administration like its subordinate.

He said nowadays, democracy was exploited with just a claim of majority votes which could do even evil things to the country with no regard to minority voice.

This is not democracy, he said, adding that everybody must have discipline and maintain rules of law, and discipline now has to be taught and trained from childhood.

Dies ist genau das Problem im heutigen Thailand.
Aber es wird sich nichts ändern solange skrupellose Leute wie Thaksin hier die Macht erhalten können.

Richtig. Aber Thaksin wird keinen anerkennen lassen der nicht seine Marionette ist.
Schliesslich weiss er dass er jede "demokratische Wahl" hier gewinnen würde.
Und eine wirkliche "neutrale" Untersuchung würde nur ihm und seinem Marionettentheater schaden.

und während der gesamten Beratungszeit über Thaksins Selbstbedienungs Persilschein
nichts zu sagen hatten, liess der grosse Führer sie plötzlich wieder auferstehen.

Ha, ha! Da lässt Thaksin seine gekauften "Advokatenlehrlinge" reklamieren dass ein Gericht ohne
die Staatsanwaltschaft (AOG) aktiv wird.
Da die Thaksin gesteuerte AOG in garkeinem Fall gegen ihren grossen Führer und dessen Marionettenbühne
ermitteln würde haben wir ja nochmal bannig Glück gehabt!
